These Consignment Terms of Service (“Terms”) explain the rules for using our website, services, and tools (together, the “Service”). By using OFS, you agree to follow these Terms. Please read them carefully. If you don’t agree, you shouldn’t use our Service.
Note: By using OFS’s consignment service, you also agree to our general Terms of Service and Privacy Policy.
1.Consignment Process
1.1 Apply
- To start selling with us, fill out the consignment application on our website.
- You’ll need to provide:
- Your contact details
- A detailed description of the items you want to sell
- Clear photos of each item
- The amount of payment you require per item after it sells, and any additional info on the items
- Once you apply, we’ll review your submission. If approved, we’ll email you with the next steps.
1.2 Shipping Items to OFS
- After approval, ship your items to OFS for us to inspect and list them.
- We recommend you get shipping insurance to protect the value of your items.
- Make sure to save the tracking number so you can monitor the shipment.
- OFS isn’t responsible for items that get lost or damaged during shipping, even if they are marked as “delivered” by the carrier.
- We reserve the right to refuse delivery of items that are damaged or don’t meet our standards.
- Once we receive your items, we’ll confirm with you and provide further instructions.
1.3 Photographing, Pricing, and Listing
- We may use your photos or take new ones to show your items in the best light.
- OFS will set the selling price based on market trends, and we may adjust it over time to help your item sell faster. Your payout will stay the same.
- The list price will be typically $25 – $75 higher than the amount you request. Keep this in mind when setting your desired price.
- We will list your item on our site and may edit your description to improve its chances of selling.
1.4 Payment
- After your item sells and we receive payment from the buyer, we’ll send you the full amount you requested.
- Payments are processed through PayPal, so make sure to provide us with your correct PayPal email address.
- You’ll receive your payment within 14 business days after the sale is finalized.
2.Removal of Consigned Items by Consignor
If you wish to have your item removed from our listings:
- Notify us, and we will remove your listing as soon as possible, typically within 7 days. Contact information is available on our Contact Us page.
- We will carefully and securely pack your items for return. All items will be shipped via USPS Priority Mail.
- We will send you an invoice for the return shipping cost. Upon payment of the invoice, we will promptly return your items.
- Once the tracking for your return items indicates that they have been delivered, we will consider the items successfully delivered and in your possession.
- If your items arrive broken or damaged, please notify us within 7 days of delivery and provide photos of the damaged items. Each situation will be analyzed on a case-by-case basis, and we will do our best to rectify the issue to ensure your satisfaction.
3.Removal of Consigned Items by OFS
If we decide to remove your item from our listings:
- Although we strive to keep all consignors’ items listed and sold, there may be various reasons why we choose to remove your product from our site.
- If we make this decision, we will notify you by email.
- All items will be carefully and securely packaged and shipped via USPS Priority Mail, and we will provide you with the tracking number. There will be no charge to you (the consignor), and we will cover the shipping costs.
- Once the carrier’s tracking shows that the item has been delivered, we consider the item to be in your possession.
- In the unfortunate event that the item gets damaged in transit, please notify us within 7 days, accompanied by photos of the damaged item. Each situation will be analyzed on a case-by-case basis, and we will do our best to rectify the situation to ensure your satisfaction.
4.Limitation of Liability
OFS provides the Service on an “as is” and “as available” basis. We make no warranties or representations regarding the accuracy, reliability, or availability of the Service. To the fullest extent permitted by law, OFS disclaims all warranties, express or implied, and will not be liable for any damages arising from your use of the Service.
5.Indemnification
You agree to indemnify and hold harmless OFS, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
6.Termination
OFS reserves the right to terminate or suspend your account and access to the Service at any time, with or without cause or notice. Upon termination, you remain responsible for any obligations incurred before the termination.
7.Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the state in which OFS operates, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
8.Changes to These Terms
OFS may update these Terms from time to time. We will notify you of any significant changes by posting the new Terms on the website and updating the date at the top of this page. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
